Paul J. Richter has been engaged in the practice of law since 1971. With an emphasis on rendering legal services to financial institutions, real estate owners and developers, members of the construction industry, and members of the machine tool industry, he concentrates in the areas of litigation, trial, real estate mortgage foreclosures and work-outs, and secured loan documentation. Mr. Richter’s experience in litigation includes the defense of claims brought against financial institutions and corporations, including breach of warranty, class, and RICO actions, together with creditor’s collection and bankruptcy matters. He renders substantial legal services to creditors with secured claims in bankruptcy in order to retain, take possession of, and liquidate collateral, and he represents corporations in buy-sell and Uniform Commercial Code (UCC) matters. He also represents developers, general contractors, and subcontractors in construction contract claims and mechanics lien litigation on private and public projects. Mr. Richter has also been involved in insurance company policy interpretation, claims, and litigation involving bankers' blanket bonds, bonding company matters, certain securities work, and state and federal transactions pertaining to shareholders’ rights, and options and commodity exchange regulations. He works extensively in structuring, negotiating, documenting, and closing complex commercial real estate and loan transactions. Mr. Richter has also been engaged by the Federal Deposit Insurance Corporation (FDIC) and Resolution Trust Corporation (RTC) in the liquidation of financial institutions and their assets, in the sale of commercial real estate, and in other transactions. He represents corporations in litigation involving the Uniform Commercial Code (UCC) and breach of warranty, as well as, in extensive interstate buy-sell arrangements. As a lecturer for the Illinois State Bar Association, Chicago Bar Association, the Illinois Bankers Association, and at financial institution seminars, Mr. Richter speaks on a variety of topics, including purchase and sale of real estate, loan documentation, the Illinois Interest Act, litigation, director’s and officer’s insurance, blanket bond policies, real estate, work-outs, the Bankruptcy Code, and consumer transactions and certain regulatory matters. Mr. Richter is a co-author of the Collateral Loan Documentation Handbook.
